Puppy Purchase Agreement

In consideration of their mutual promises contained herein, Seller and Buyer agree as follows:

1. Seller agrees to sell and Buyer agrees to purchase a miniature schnauzer puppy. This puppy is an AKC registered
purebred:
black / black & silver / salt & pepper               Male / Female  

2. Buyer shall take possession of the schnauzer upon execution of this agreement, and full ownership of the schnauzer
shall pass to buyer at that time.

3. Buyer agrees that schnauzer is being purchased for $______with AKC limited registration therefore said schnauzer is
being purchased as a home companion and will not ever be bred. Buyer agrees to never register and/or dual register
said schnauzer with any other registry other than AKC. Buyer further agrees to have a licensed veterinarian spay/neuter
said schnauzer no later than May, 2009.  Should the puppy not be spayed/neutered by 7 months of age, the health
guarantee as follows will be null and void.  
 
4. Buyer hereby certifies that this purchase is not made by the buyer as an agent for any other person or entity, and
further agrees that neither the schnauzer nor its offspring shall be sold, given away or traded to any person, pound,
humane society, shelter, agent, pet store, mass commercial kennel, or puppy mill.  If for any reason, at any point in
time, you are no longer able to keep this puppy please call us. If we are not able to take this puppy back we are more
than happy to assist you in placing it in a loving home. Purchaser agrees to never surrender this dog to an animal
shelter and agrees to give breeder first opportunity to take ownership.

5. Buyer agrees to provide the highest quality care for said schnauzer, high quality food, fresh water available at all
times, shelter from heat and cold, active companionship, appropriate exercise, proper socialization, grooming, flea
prevention, professional veterinary care whenever necessary. Appropriate professional veterinary care includes but is
not limited to, annual exams, internal parasite checks yearly, and de-worming if necessary, remaining current on all
vaccinations including bordertella.  Your new puppy has been eating Nutro Ultra Puppy food. Please continue to feed
this to avoid diarrhea. Although we highly recommend a high quality food such as Nutro Ultra Puppy if you chose to
change your pet’s diet, please do this gradually by mixing the two 50/50, gradually phasing out one. If your puppy
doesn't eat, vomits or has diarrhea or appears to be weak within the first 24-48 hours notify your vet immediately-
Please don't wait. Puppies can dehydrate very rapidly and your puppy’s life may depend on your quick response.

6. Puppy showing a life threatening genetic disease or life threatening genetic defect will be replaced as follows in
section 6-A or section 6-B.

6-A. The family schnauzer puppy was examined by a licensed veterinarian on or before  ____ 2009 and was found to be
in good health and free of disease or genetic defect. Buyer agrees to take schnauzer to a licensed veterinarian within 3
days (72 hours) of date of purchase (or upon shipping). If a licensed veterinarian determines said schnauzer has a life
threatening disease or genetic defect within 3 days (72 hours) after the time of purchase, a replacement pup will be
offered.   Buyer agrees that seller is not responsible for any vet bills or transportation costs. Buyer and seller both
agree that sale is final after 3 days.

6-B. Puppy must show genetic defect by 1 year of age and be examined by a licensed veterinarian. The breeder must
be notified at once at the onset of the problem, in written report from the vet. Breeder may require buyer to get a 2nd
opinion at breeder’s veterinarian of choice. The breeder’s veterinarian will interpret the reports, if he concurs, then the
next available replacement puppy will be given. A puppy with a life threatening genetic defect must be returned or with
prior permission from breeder may be euthanized to qualify for replacement pup. A returned puppy must be returned
in good condition other than the specific problem, at the buyer’s expense. The Buyer will then qualify for a
replacement pup, we do not offer refunds on money paid under any circumstances. Breeder is not responsible for any
veterinary costs or transportation costs for the puppy. No replacement puppy will be given if the puppy has been bred,
or euthanized without the breeder’s permission.   We breed for quality pets and do not guarantee as to the disposition,
confirmation, size, color or breeding/show capability of puppy purchased. This health guarantee does not include
hypoglycemia, worms, kennel cough, coccidia, or other common treatable illnesses.  These are common occurrences
found in puppies that can be treated and we take precautions to avoid these conditions.
6-C.  We feel so strongly about NuVet supplements that we also offer an additional one-year health guarantee. Buyer
understands that he/she must keep the said puppy on a daily serving of NuVet Plus Canine for a period of Two (2)
years to be eligible for the health guarantee as explained in this contract.  We highly recommend this product as
processed dog foods are lacking the nutritional values vital to your dog’s health and immune system. A monthly
report is sent to Masterpiece Schnauzers by NuVet Labs detailing which of our dogs is being supplemented with NuVet
Plus Canine, so Buyer further agrees to only purchase NuVet Products using the following distributor number for
tracking purposes which keep your health guarantee in effect.  To order this product online, please go to www.Nuvet.

your pet on this supplement will render all guarantees null and void.  
7. Buyer agrees to vaccinate as follows: age 10 weeks while continuing vaccinations every 21-28 days from the date of
the previous set with the last set to be given on or after 16 weeks of age. After you have completed the puppy series
you will also need to vaccinate for Bordertella and Rabies. I do not recommend vaccinating for Leptospira unless you
talk to your vet about this being in your area and a real need for this vaccination.  Many schnauzer bloodlines have
adverse reactions to Leptospira and some have even resulted in death.  A detailed account of your puppy’s care has
been provided. Please take that health record with you to your first vet visit. Please be prepared to follow your vets
advice on scheduled vaccines, wormings & heart worm preventative.

8. Buyer agrees when said schnauzer is outside it shall be kept in a secured fully fenced yard or on a leash at all times
and never allow the schnauzer to roam free. Buyer further agrees that schnauzer shall wear a collar or harness with
current identification tag at all times. This schnauzer will never, at anytime, be chained, tied to a stake or otherwise
tethered outside. Schnauzer will always live and sleep in the home as a family member.


THE PARTIES AGREE TO BE BOUND BY THE FOLLOWING GENERAL CONDITIONS:
1. This agreement is binding upon the parties, hereto, their heirs, successors and/or assignees.

2. If litigation is necessary to enforce any of the provisions of this agreement, It must be resolved in my venue. The
prevailing party shall be entitled to all reasonable court costs and attorney fees.
